Barry B. Ramey
Barry Ramey, 40, from Plantation, FL, is a former security officer and currently the owner of a small photography studio enabling him to buy a home. Barry was happy in 2020 and became engaged to be married.
Like millions of Americans, Barry was shocked by the sudden swing in vote counts on election night 2020 and early following day. In the dead of night, six swing counties in which President Trump was ahead simultaneously stopped counting votes. Early the next morning, the vote counts continued, but suddenly thousands of Biden ballots appeared, and Biden was comfortably in the lead in all six counties. There has never been a satisfactory explanation. It is well known that Democrats favor early voting, and Republicans tend to vote on election day; those “banked” Biden ballots should have been the first to be counted.
Responding to President Trump’s call to peacefully assemble on January 6th, 2021, Barry traveled to Washington, DC, to peacefully protest what they firmly believed to be a fraudulent 2020 election. Following President Trump’s remarks to the assembled group of patriots near the White House, Barry walked with the crowd toward the Capitol building.
According to court documents, on the morning of January 6, Barry joined a large group of Proud Boys that gathered at the Washington Monument. After receiving instructions near the Washington Monument, court documents say that the Proud Boys began to march eastward on the National Mall toward the Capitol starting at about 10:45 a.m.
The trouble is, Barry has never acknowledged being a member of Proud Boys. In fact, the DOJ’s own Statement of Facts document does not prove that Barry is a member. That document relies on hearsay from confidential sources, and the existence of a telephone number of Barry’s that these confidential sources say was part of their “master list.” No list was ever introduced into evidence.
Court records allege that Barry and the other Proud Boys then circled the Capitol, “casing” the grounds for weak points in the security perimeter. At approximately 1:48 p.m., several U.S. Capitol Police officers were attempting to block access to the stairwell leading from the Lower West Terrace to the Upper West Terrace of the Capitol building.
Court documents further allege that Barry was in a group that pushed forward into the officers, pushing them back and up the stairwell. They state that Barry sprayed two officers in the face and eyes with pepper spray. Both officers reported that the spray caused them to become disoriented and have their vision impaired, however, having reviewed the footage, neither officer could point to Barry as the one who sprayed them. It was also never proven that the spray used was pepper spray, only that the effects were, “consistent with pepper spray.”
The DOJ alleged that the group, including Barry, pushed past the remaining officers, and moved up the stairs to the West front of the Capitol. They allege that Barry and the group he was with stayed on the Capitol grounds for four-and-a-half hours. The prosecution and the defense agree that Barry never entered the Capitol building.
Barry was arrested at his home on April 21, 2022. He was initially charged with: Civil Disorder; Assaulting, Resisting, or Impeding Certain Officers Using a Dangerous Weapon; Assaulting, Resisting, or Impeding Certain Officers Using a Dangerous Weapon; Entering and Remaining in a Restricted Building or Grounds with a Deadly or Dangerous Weapon; Disorderly and Disruptive Conduct in a Restricted Building or Grounds with a Deadly or Dangerous Weapon; Engaging in Physical Violence in a Restricted Building or Grounds with a Deadly or Dangerous Weapon; and, Act of Physical Violence in the Capitol Grounds or Buildings.
Later, Barry was accused of interfering with an FBI investigation. An FBI agent received a threatening call from a phone number that the FBI could not trace (a burner phone). The caller asked for the agent by name, and then delivered a threatening message. Although Barry was accused of this, the call occurred before Barry was arrested and before he was interviewed by the FBI.
Following a bench trial before U.S. District Court Judge Dabney L. Friedrich, Barry was found guilty on March 3, 2023, of felony charges of civil disorder and assaulting, resisting, or impeding certain officers. He was also convicted of misdemeanor charges of entering and remaining in a restricted building or grounds; disorderly and disruptive conduct in a restricted building or grounds; engaging in physical violence in a restricted building or grounds; and act of physical violence in the Capitol grounds or buildings.
Barry was sentenced to 60 months in prison. In addition to the prison term, Judge Friedrich order three years of supervised release and restitution of $2,000 to the Architect of the Capitol.
The mainstream media and some federal officials routinely label anyone associated with the January 6th protest as a “domestic terrorist” or “insurrectionist” despite the fact that the term “domestic terrorist” is not defined in the Patriot Act. This allows them to destroy Constitutional rights, such as a speedy trial. Likewise, no one associated with January 6th has ever been charged with, let alone convicted of, insurrection.
His fiance, on his GiveSendGo page tells the story of his treatment in prison:
My fiance, Barry Ramey was arrested on 4/21/22 on a warrant/complaint regarding January 6th by Federal Agents and falsely accused of interfering with an FBI investigation. He has moved through over 12 locations in just over a year with horrible conditions, lack of medical treatment and in some cases no availability to ordering food, suffering through mistreatment at Northern Neck Regional Jail, then moving through solitary confinement in Alexandria, on to trial and sentencing in DC. Just after sentencing he was moved to Petersburg solitary confinement where he was medically neglected, prevented from making phone calls, deprived of basic necessities and never let out of his cell. As his family, we have been supporting the expensive process of legal, phone calls, clothing and additional food since the food is barely edible and has roaches, hair and other non-food items at times
Now, he is finally at his “designated” location in Miami.
