Then 52-year-old Gregory went to Washington, D.C. to attend the January 6^th rally and hear President Trump speak. After the President’s speech, he followed the crowd and ended up at the Capitol Building. He ended up at the Capitol’s East House Doors.

At around 2:21 pm, Gregory hit a door with the end of a flagpole in a failed attempt to enter the building. Within minutes, chaos was erupting between the crowd and law enforcement and officers were battling the crowd. In the confusion, Gregory struck a Capitol police officer with the flagpole. He threw the flagpole in the direction of the officer and moved back into the crowd.

Around 2:30 pm, Gregory used a black baton to hit the glass portions of the East House Doors. When the glass broke, he entered the Capitol Building. It is unclear (but presumed) that he found the baton on the ground. There is no evidence of him bringing a baton to Washington D.C. with him, nor is there any evidence that he did anything besides talk on his cell phone once inside the Capitol Building.

Gregory was arrested on November 10^th, 2021 in Cleveland, Alabama. He was charged with a few felonies, including assaulting, resisting, or impeding certain officers using a dangerous weapon and inflicting bodily injury on certain officers. Of course, several misdemeanors were ‘stacked’ to try and get a longer sentence.

On November 23^rd, he pleaded not guilty to all eight charges against him and was released to his recognizance. On December 16^th, 2022, Gregory took a plea agreement and entered a plea of guilty to the 2^nd count of the indictment (assaulting, resisting, or impeding certain officers). His sentencing was originally set for March 2023. Gregory was sentenced on June 2^nd, 2023 to 42 months of incarceration followed by two years of supervised release. In addition, he was ordered to pay restitution of $2,000 and a special assessment of $100. Gregory was allowed to self-surrender to begin his prison sentence.
